Big Social Media In Court
In a landmark Los Angeles trial that began on January 27, 2026, a jury reached a historic verdict finding Meta and Google liable for creating addictive platforms, awarding a 20-year-old plaintiff $6 million in total damages. The case is part of a large California state court proceeding that combines more than 1,600 lawsuits filed by families and school districts against Meta (Instagram and Facebook), Snap, TikTok, and YouTube’s parent company, Alphabet. The Los Angeles case is the first of these lawsuits to be presented to a jury, with TikTok and Snap reaching 11th-hour settlements to avoid facing the jury. This initial verdict against Meta and Google poses an existential threat to the engagement-based business models of Big Tech and sets a powerful precedent for thousands of pending multidistrict cases.
The plaintiffs allege that the companies built features such as infinite scroll, algorithmic content recommendations, and push notifications to increase the amount of time teenagers spend on their platforms. They argue that these features operate as habit-forming systems and contribute to anxiety, depression, eating disorders, and greater demand for school-based mental health services.
Separate from the California state court case, more than 235 plaintiffs have filed similar lawsuits in federal court against Meta, Snap, TikTok, and Alphabet. Those cases have been grouped together before one federal judge so they can be managed in a single proceeding. The federal case includes a complaint filed by California Attorney General Rob Bonta and a bipartisan coalition of at least 32 other state attorneys general. The federal judge overseeing the federal proceeding has said trials are slated to begin on June 15.
The companies deny wrongdoing in both the state and federal proceedings and argue that their platforms provide social value, offer parental controls, and that responsibility for minors’ use rests primarily with families.
A second standalone trial is tentatively set for August 5th, following the Kentucky school district's bellwether. This trial will cover claims under the Children’s Online Privacy Protection Rule Act (COPPA) and consumer protection claims from four lead states: California, Colorado, Kentucky, and New Jersey. The judge will allow the states a jury trial to the extent they are entitled to one, potentially impaneling an advisory jury for public interest issues.
Judge Gonzalez Rogers, who oversees the social media addiction multidistrict litigation, has criticized Meta for attempting to move arbitration demands filed by young Instagram users into the court's jurisdiction. The judge questioned Meta’s inconsistent position on favoring arbitration and doubted her jurisdiction over the demands, despite their inclusion in Meta's terms of use. Meta argues that arbitration is required for claims involving users over 18, while plaintiffs argue the provision is unenforceable. Lead class counsel agreed with Meta that any arbitration should be subject to the MDL’s common benefit order.
Snapchat and TikTok have settled individual claims, but not the consolidated personal injury cases or the Judicial Council Coordination Proceedings (JCCP).
The Erosion of Section 230 Immunity
For years, social media companies have benefited from the protection of Section 230 of the Communications Decency Act, which has been interpreted to exempt social media platforms from user-generated content. These claims, however, allege that the platforms' own data-driven algorithms illegally harvest private information on children’s online activities to encourage compulsive use. These features include parental controls, age verification processes, barriers that make it more difficult to delete an account than to create one, and inadequate processes to report suspected child sexual abuse material (CSAM).
The United States District Court for the Northern District of California denied a motion for summary judgment filed by social media platforms on February 9, 2026. The platforms raised Section 230 as a defense, but the court gave the plaintiffs an opening: they could proceed on a core theory of injury which “focuses on the impact of compulsive use itself, irrespective of third-party content.”
The defendants relied on precedent, namely Lemmon v. Snap Inc. and Doe v. Grindr. Defendants claimed that for a claim to be immune from a Section 230 defense, it must be fully independent of the platforms’ role in monitoring or publishing third-party content, as it was in Lemmon. In Grindr, comparatively, the defective features were not fully independent of third-party content, and therefore, Section 230 applied. The Court here concluded that the defects of parental controls, age verification, account deletion, and CSAM reporting, among others, are sufficiently independent from content to avoid Section 230.
For decades, Section 230 of the Communications Decency Act provided a nearly impenetrable shield for tech companies, immunizing them from liability for third-party content posted on their platforms. However, the current wave of litigation relies on a novel and highly effective legal strategy: distinguishing between the content users post and the design of the platform itself.
Plaintiffs argued that platform features such as infinite scrolling, autoplay, intermittent variable rewards (likes and notifications), and algorithm-driven recommendations are actionable "product designs" rather than protected speech. In landmark rulings leading up to the 2026 trials, judges, including California Superior Court Judge Carolyn B. Kuhl and U.S. District Judge Yvonne Gonzalez Rogers, affirmed this "design vs. content" distinction. By ruling that Section 230 does not offer absolute protection for defective platform architecture, courts could open the door for claims of strict liability, negligence, and failure-to-warn to proceed to trial.
New Strategy: The Application of Product Liability and A/B Testing
With Section 230 sidelined, plaintiffs are utilizing traditional product liability frameworks, arguing that social media apps are defectively designed products that bypass adolescent impulse control. To prove that companies knew of the dangers their designs posed, plaintiffs are weaponizing the tech industry's own development methods against them, specifically A/B testing. A/B testing (or split testing), a process where product managers test alternate designs on users to maximize engagement, is highly documented within these companies. In the courtroom, the results of these internal tests serve a dual purpose:
Proof of Knowledge: They demonstrate that the platforms had granular data showing exactly how specific features increased compulsive use and worsened mental health among minors, yet chose to prioritize engagement and advertising revenue.
Proof of Causation: The internal data tracking user behavior directly links algorithmic tweaks to behavioral changes, helping plaintiffs bridge the difficult legal hurdle of proving that the app's design—rather than external societal factors—caused the psychological injuries.
Legal experts and plaintiffs' attorneys are explicitly drawing parallels between Big Tech and Big Tobacco. “These are the trials of a generation; just as the world watched courtrooms hold big tobacco and big pharma accountable, we will, for the first time, see big tech CEOs take the stand,” said Sacha Haworth, the executive director at Tech Oversight Project. This strategy relies heavily on unsealed internal corporate documents obtained during discovery, particularly those leaked by whistleblowers, echoing how lawsuits from the last century exposed companies like Philip Morris and R.J. Reynolds, who hid critical information about the harms of cigarettes from their consumers.
The discovery process has unearthed highly damaging internal communications that undermine the companies' public defenses. For instance, internal Meta messages revealed engineers referring to Instagram as "a drug" and themselves as "pushers," while acknowledging they were causing "Reward Deficit Disorder" in young users.
The Expansion of Plaintiffs: Public Nuisance and Institutional Harms
A unique implication of this litigation is the expansion of tort law to include institutional plaintiffs under a “public nuisance” theory. Hundreds of school districts have joined the litigation, arguing that they are bearing the economic brunt of the youth mental health crisis. School districts allege that the platforms' addictive designs have forced them to divert millions of dollars in educational funds toward hiring mental health counselors, managing classroom disruptions, and repairing property damage linked to viral social media challenges. In a pivotal ruling, Judge Gonzalez Rogers allowed these public nuisance and negligence claims to proceed, paving the way for the first school district bellwether trials in June 2026. If successful, this could establish a precedent where tech companies are held financially liable for the downstream societal and economic costs of their business models.
Strategic Settlements and the Future of "Safety by Design"
In January 2026, just days before the first bellwether trial (K.G.M. v. Meta et al.) was set to begin, both Snap and TikTok reached confidential settlements to avoid facing a jury and having their executives testify publicly. For the remaining defendants, Meta and Google, the 2026 trials pose a profound risk. Should juries consistently return verdicts in favor of the plaintiffs, it will trigger an avalanche of liability across thousands of pending cases. More importantly, it may force an industry-wide shift toward "safety by design.” This approach generally involves implementing age verification systems and parental supervision tools, as well as setting default limits on session lengths and frequency. To address concerns over extended usage, proposed safety-by-design measures include removing features like infinite scroll and autoplay to establish a definitive end to content feeds, and restricting push notifications during specific periods, such as school hours or overnight. Additionally, it encompasses modifying algorithms to reduce engagement-maximizing recommendations, displaying mental health warning labels, and placing labels on images that have been altered with beauty filters. Finally, the concept extends to removing navigational barriers for account deletion and utilizing proactive detection tools, such as Project Arachnid Shield, to identify and block child sexual abuse material (CSAM).
Conclusion
The historic Los Angeles jury verdict represents a significant development for Big Tech, indicating a shift in the industry’s approach to accountability. By challenging the protections of Section 230 and presenting these platforms as products with potential flaws rather than neutral publishers, the plaintiffs achieved a notable outcome. The jury found Meta and Google responsible for the design and operation of their platforms and determined that the companies acted with “malice, oppression or fraud,” assigning Meta 70% of the $6 million award and YouTube 30%.
In addition to the strategic settlements by TikTok and Snap, these results establish a precedent for evaluating and resolving numerous pending cases. Whether through large jury verdicts, regulatory changes, or strategic settlements, this litigation presents a challenge to engagement-driven revenue models and highlights the increasing accountability within the tech industry.
